The NCAA qualifies for the non-profit exemption because it claims to be "organized and operated exclusively for educational purposes."

And there have been many investigations into whether the NCAA, conferences, and school athletic departments have misused their tax exempt status as non-profit entities

From the NCAA website "The NCAA is a nonprofit, higher education association that is exempted from federal income tax by section 501(c)(3) of the federal tax code."
